Meaning
Temporary directives issued by an arbitration tribunal protect disputed assets before a final ruling. An arbitral interim order maintains the status quo between contracting parties during a dispute. This measure remains in force until the tribunal delivers its final award.
Procedural Status
Binding authority is granted to these temporary rulings under most international arbitration rules. For example, if a supplier is accused of using unreleased firmware, the arbitral interim order can halt the distribution of affected IoT modules. This action prevents the commercialization of disputed intellectual property during the proceedings.
Production Consequence
Halting assembly operations is the most severe outcome when a factory receives such a directive. The manufacturer pauses production lines and freezes the shipment of finished smart devices to comply with the mandate. Since components are already purchased, this sudden pause generates substantial holding costs and shifts warehouse logistics.
Furthermore, supply chain schedules must be renegotiated with secondary buyers to minimize financial damages.
Judicial Enforcement
Recognition of the ruling by local courts is necessary to guarantee compliance if a party resists. Although tribunals issue these decisions, the local court in the manufacturer’s country enforces the arbitral interim order. Without this judicial support, the ruling has limited physical effect.
